1. What do we do?

Our business is a therapeutic treatment Platform that helps people who have difficulty sleeping through a sleep monitoring program and habits that may be helping or hindering sleep quality, based on Cognitive Behavioral Therapy for insomnia (CBT-I), providing a set of online resources through daily interactions with Sônia, our digital coach, where users learn the main techniques and behavioral changes to sleep better. Vigilantes do Sono does not work with medication recommendations, teas, essential oils, sedatives, nor is it linked to any professional council.

Additionally, Vigilantes do Sono also provides services for anxiety and depression treatment also based on Cognitive Behavioral Therapy.

2. Is the use of our Platform paid?

Users may have access, free of charge, to some platform features, such as quizzes and scientifically proven sleep information and tips. However, to access the full program, Users must pay fees to use Vigilantes do Sono services, making the payment for the commercial format they choose. These values will always be displayed before you make the purchase.

3. Is it safe to use our Platform?

We work hard to make our Platform safe, but we still recommend that before downloading any content, you install antivirus and protection programs.

4. Can these conditions be changed?

Our Terms of Use may change, but you will always be able to access the most up-to-date version on our Platform. Additionally, if we need to take any action that requires your authorization by law, you will receive a notice beforehand to accept or decline.

5. What happens with personal data?

We have a Privacy Policy that addresses what we do with your personal data. It's very important that you read and understand this document as well!

This Platform, named Vigilantes do Sono, is owned, maintained and operated by VIGILANTES DO SONO - QUALIDADE DE VIDA E TECNOLOGIA LTDA, a private legal entity registered under CNPJ/ME number 36.658.510/0001-06, headquartered at Av. Dr. Arnaldo, 2194 - Sumaré, São Paulo - SP, Brazil. ZIP: 01255-000.

This document aims to provide information about how Users use the Platform and its tools, conditions, nomenclatures, rights and duties, as well as preserving Users' privacy. We warn that the entire text must be read carefully and, if you do not agree with the content of our terms and/or privacy policy, do not proceed with navigation or use of our services. We also recommend that if accepted, you store or print a copy of this contract, including all policies.

1. Text availability date

1.1. This version of this document was made available on: 08/12/2025.

2. Explanation of technical terms or foreign language terms

2.1. Below are the meanings of technical nomenclatures and terms in English.

• Login: It is the process that allows access to a computer system, controlled through identification and authentication of the User by the credentials provided by the same user.

• Online: Term meaning "connected". It is commonly used to indicate that a particular Internet user or other computer network user is connected to the network.

• Virus: Malicious software that infects systems and computers, with the objective of causing some damage, makes copies of itself and tries to spread to other computers, using various means.

  2.2. The types of Platform Users are:

• Client User: One who seeks the Platform to improve sleep quality, through a sleep and habits monitoring program.

• Healthcare Professional User: One who recommends the Vigilantes do Sono Platform to care for the Client User, as well as monitors the therapeutic treatment through the Platform.

• These Users, together, will be called simply Users.

3. Services

3.1. What we are: Vigilantes do Sono consists of, but is not limited to, a therapeutic treatment Platform that helps people who have difficulty sleeping through a sleep monitoring program and habits that may be helping or hindering sleep quality, based on Cognitive Behavioral Therapy for insomnia (CBT-I), providing a set of online resources through daily interactions with Sônia, our digital coach, where users learn the main techniques and behavioral changes to sleep better. Additionally, Vigilantes do Sono also provides services for anxiety and depression treatment also based on Cognitive Behavioral Therapy.

3.1.1. Vigilantes do Sono does not work with medication recommendations, teas, essential oils, sedatives, nor is it linked to any professional council.

3.1.2. Vigilantes do Sono cannot provide its services to Client Users in urgent or emergency situations. In these cases, we recommend seeking specialized professional help.

3.2. By using Vigilantes do Sono, the User must understand and accept that all their actions and choices are free and have no influence or interference from Vigilantes do Sono.

3.3. It is clarified that this service does not establish any employment, corporate or associative relationship between the parties, with each party remaining solely responsible for all their respective expenses and charges, whether of labor, social security, tax, insurance, civil, criminal or any other nature or type.

4. Your health

4.1. You acknowledge and agree that Vigilantes do Sono is a personalized self-help system designed to help you improve your own sleep and that, if you choose to access Vigilantes do Sono, you are solely responsible for deciding which suggested techniques you practice and how to apply these techniques.

4.2. You also acknowledge and agree that Vigilantes do Sono is not intended to diagnose, treat or solve any medical problem and the material in the System, published by Vigilantes do Sono employees or other users, is provided for your information and not as medical advice and should not be viewed as a substitute for consultation with a physician or other qualified healthcare professional. If you receive advice from a physician or other qualified medical professional that conflicts with anything contained in the System, the former should prevail.

4.3. You are advised to seek medical advice before starting any sleep improvement program. If you are concerned about your sleep problem, or if you frequently struggle to stay awake during the day, or if you are pregnant, or if you fall asleep during the day unintentionally, or if you have other concerns or questions about your health or medications, you should always consult an appropriate healthcare professional.

4.3.1. Be cautious when making changes to your sleep pattern if you have any serious mental health condition, including (but not limited to) depression, bipolar disorder or schizophrenia.

4.3.2. Similarly, be cautious when starting vigorous exercise if you have any serious medical condition, including (but not limited to) back pain, high blood pressure or heart disease, or if you are pregnant.

4.3.3. If you feel too sleepy during the day, for any reason, do not take risks when driving or operating machinery or other equipment. Always seek professional medical advice when contemplating changes to prescribed medications.

4.4. The Vigilantes do Sono team is responsible for the information provided in Vigilantes do Sono and if we find or are alerted to an error, we will correct it as quickly as possible. However, to the maximum extent permitted by applicable laws, the authors and editors are responsible for errors or omissions or for any consequences arising from the application of information in Vigilantes do Sono, and do not offer any warranty, express or implied, with respect to the content, completeness or accuracy of the published material.

5. User registration

5.1. For registration and use of Vigilantes do Sono services, the following information will be required from the Client User: full name, photo, gender, email and phone. We will also collect data from interaction, form filling and message sending on our websites and applications (e.g., session and technique evaluations, sleep diary, use of taught techniques, sleep-related habits and pre-existing medical conditions).

5.2. Each User will determine their login and access password, being exclusively responsible for maintaining the confidentiality of this information. Vigilantes do Sono is not responsible for actions and damages that may be caused by unauthorized access to the account by third parties.

5.2.1. Vigilantes do Sono will never request your password, credit card data or other personal information via email, whatsapp, instagram or phone contact.

5.3. Registration on the Platform is permitted only to people over 18 (eighteen) years old and Vigilantes do Sono will make reasonable efforts to confirm this data, but is not responsible if the registered person does not have the minimum age described here.

5.4. Users are responsible for providing true, accurate and up-to-date information.

5.5. Vigilantes do Sono may refuse, suspend or cancel without prior notice the access account of a User whenever it suspects that the information provided is false, incomplete, outdated or inaccurate or, still, in cases indicated in applicable laws and regulations, in these Terms of Use or in any Policy.

6. Payment for platform use

6.1. Users may have access, free of charge, to some platform features, such as quizzes and scientifically proven sleep information and tips. However, to access the full program, Users must pay fees to use Vigilantes do Sono or partner services, making the corresponding payment or having the program funded by third parties. These values will always be displayed before you make the purchase.

6.1.1. All prices shown on the website include applicable taxes and fees. Vigilantes do Sono may change prices from time to time. Any price change will be published on our Platform.

6.1.2. We reserve the right to change the subscription fee and billing methods at any time and will notify you of all such changes before the renewal date when changes are implemented. Your continued use of the system will constitute acceptance of such changes.

6.1.3. Payments will be processed by independent platforms Pagar.me, Google Play, App Store or Mercado Pago, depending on the User's choice. We recommend that you read the Terms of Use of these platforms before making payments at Vigilantes do Sono.

3. Conditions for money refund

6.3.1. The refund guarantee by Vigilantes do Sono applies to virtually everything on our website and there is no extra fee for the User. It is automatic and covers your purchase price plus any refund costs.

6.3.2. If you purchased any paid service through our website, you have the right to cancel your purchase and receive a full refund of the amount paid for the right to the service within 07 (seven) days after payment to Vigilantes do Sono without any conditions.

6.3.3. If you qualify for any of the conditions set forth, simply follow these steps to receive the refund:

• Inform in writing by sending an email to contato@vigilantesdosono.com, indicating the reason for the refund.

• You must include in this email your preferred contact email, full name, purchase date and proof of purchase and reason for refund.

• After receiving your refund request and provided you qualify for the conditions set forth in this Agreement, Vigilantes do Sono will send an email confirming approval of the refund, after which payment will be made within 30 (thirty) days. Once a refund has been made for a paid service, you will no longer have rights to access Vigilantes do Sono content and features.

  6.4. Cancellation of Vigilantes do Sono Services

  6.2.1. To cancel services, the User must send an email to contato@vigilantesdosono.com or go to Av. Dr. Arnaldo, 2194 - Sumaré, São Paulo - SP, Brazil. ZIP: 01255-000.

  6.2.2. To find out what we do with personal data processed during the Platform use journey, access our Privacy Policies.

7. Responsibilities of the parties

7.1.Vigilantes do Sono's Responsibility:

7.1.1. Perform services as described in these terms of use;

7.1.2. Be responsible for the operation of the Platform and for corrections that may be necessary;

7.1.3. Inform Users of significant changes to services through simple communications on the Platform.

7.2. Client User's Responsibility:

7.2.1. Use the Platform according to the usage criteria defined by Vigilantes do Sono, without altering its programming, breaking passwords or performing procedures that may cause damage to Vigilantes do Sono, other Users or third parties;

7.2.2. Be responsible for all purposes, including legal, for the content of the information entered and for the commitments assumed on the Platform;

7.2.3. Not adopt inappropriate conduct, or practice actions or omissions contrary to these Terms of Use or Privacy Policies;

7.2.4. Fully respect these Terms of Use, Privacy Policies, current legislation and any contracts between the parties.

7.3. Furthermore, each User is exclusively responsible for their actions within the context of Vigilantes do Sono websites, platforms and applications. The User undertakes to use them in a way that does not cause damage to any rights or interests of third parties, that is, always attending to the preservation and respect of privacy, private life, honor, image and medical confidentiality of parties directly or indirectly involved.

8. Vigilantes do Sono liability disclaimer

8.1. Vigilantes do Sono is not responsible for:

8.1.1. Any unavailability of the Platform that it did not cause.

8.1.2. User conduct and breach of their obligations.

8.1.3. Entry of false information by Users.

8.1.4. Damages that the User may experience due to exclusive actions of third parties, as well as network connection failures and malicious interactions such as viruses.

8.1.5. Damages that the User may have as a result of misuse of the Platform in disagreement with these Terms, the Privacy Policy, the law or court orders.

8.1.6. Force majeure or acts of God.

8.1.7. Any loss or damage of any kind that may result, directly or indirectly, from the use or inability to use any information contained in any of the Vigilantes do Sono materials.

8.1.8. Conduct carried out by Healthcare Professional Users within the platform. Any damage caused to third parties and other Users will be the responsibility of the Professional User who carried out the conduct. Vigilantes do Sono reserves the right of recourse.

9. Rules of conduct and prohibitions

9.1. Users may not:

9.1.1. Harm the rights of Vigilantes do Sono, Platform operators, other Users, third parties or act under any means or form that may contribute to such violation;

9.1.2. Execute acts that limit or prevent the use of the Platform or illegally access Vigilantes do Sono;

9.1.3. Use the tool to practice illegal actions, such as fraud, embezzlement, misappropriation, illicit enrichment, theft and robbery;

9.1.4. Spread messages unrelated to the Platform or its purposes, including messages with inappropriate content or that offend Users, Vigilantes do Sono or third parties;

9.1.5. Hold Vigilantes do Sono responsible for recommending products and/or services that are not within the sleep and habits monitoring program, as well as not linked to Vigilantes do Sono;

9.1.6. Hold Vigilantes do Sono responsible for conduct of Users who are registered on the Platform;

9.1.7. Participate in any activity related to Vigilantes do Sono that is illegal, harmful, offensive, obscene, violent, threatening, coercive, abusive or in any way questionable by Vigilantes do Sono;

9.1.8. Reproduce, duplicate, copy or resell any part of the System in violation of this term of use;

9.1.9. Resell access to the system;

9.1.10. Frame the system or any part of it;

9.1.11. Copy any material obtained from the System to peer-to-peer networks or other websites or web services;

9.1.12. Access without authority, interfere with, damage or disrupt any part of the system, any equipment or network in which the system is stored, any software used in providing the system or any equipment or network or software owned or used by third parties.

9.2. Upon any sign of misconduct, the User may be blocked or excluded from the Platform without prior notice.

10. Intellectual property

10.1. Ownership and rights relating to the Platform belong exclusively to Vigilantes do Sono. Access to the Platform and its regular use by the User does not confer any right or prerogative over intellectual property or other content contained therein.

10.2. All Platform content, including name, brand, domain, programs, databases, files, texts, drawings, photos, layouts, headers and other elements, was created, developed and assigned to Vigilantes do Sono, being, therefore, exclusive property of Vigilantes do Sono or licensed to it and is protected by Brazilian laws and international treaties that deal with intellectual property rights.

10.3. The following are prohibited: exploitation, assignment, imitation, copying, plagiarism, application of reverse engineering, attempted intrusion (hacking), storage, alteration, modification of characteristics, expansion, sale, rental, donation, alienation, transfer, reproduction, in whole or in part, of any content of the Vigilantes do Sono Platform.

10.4. Anyone who violates the prohibitions contained in intellectual property legislation and in these Terms will be held liable, civilly and criminally, for the infractions committed, and may also be penalized on the Platform.

11. Personal data processing, privacy and security

11.1. Vigilantes do Sono has a specific policy to regulate the collection, storage and processing of personal data, as well as its security: Privacy Policies. These specific policies are inseparably part of these Terms, noting that Platform usage data will be archived in accordance with current legislation.

12. Consequences of platform access

12.1. Despite Vigilantes do Sono's best efforts to provide the best technologies to maintain online connection and synchronization and secure access for Users, due to technical difficulties, internet applications or transmission problems, inaccurate or incomplete copies of the information contained on the Platform may occur. Additionally, computer viruses or other harmful programs may also be inadvertently downloaded from the Platform.

12.1.1. Vigilantes do Sono recommends installing adequate antivirus or protectors.

12.2. Vigilantes do Sono reserves the right to unilaterally modify the Platform, as well as the configuration, presentation, design, content, functionalities, tools or any other element, including its cancellation.

13. Changes to terms and conditions of use

13.1. Vigilantes do Sono may unilaterally add and/or modify any clause contained in these Terms of Use. Whenever there are changes to these Terms of Use, we will send you a notice by email. Any material changes that intend to bind an existing System user will take effect after the change is displayed for 07 (seven) days on this page. Continued access or use of the Platform after this period will confirm the validity of the new Terms of Use by Users.

13.2. If the change made requires User consent, the option to freely, unequivocally and informedly accept the new text or refuse it will be presented.

13.3. If the User does not agree with the change, they may not provide consent for specific acts or may fully terminate their relationship with Vigilantes do Sono. This termination will not, however, exempt the User from complying with all obligations assumed under previous versions of the Terms of Use.

14. Contract violation

14.1. We will determine, at our absolute discretion, whether there has been a breach of this Agreement through the use of Vigilantes do Sono. When a breach of this Agreement occurs, we may take such action as we deem appropriate, which may include all or any of the following actions:

14.1.1. Immediate, temporary or permanent withdrawal of your right to use Vigilantes do Sono.

14.1.2. Immediate, temporary or permanent removal of any post or material uploaded by you to Vigilantes do Sono.

14.1.3. Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.

14.1.4. Disclosure of such information to law enforcement authorities as we reasonably deem necessary.

14.2. We exclude liability for actions taken in response to breaches of this Agreement. Possible actions we may take in breach of this Agreement are not limited to those described here, and we may take any other action we deem appropriate.

15. Applicable law and jurisdiction

15.1. The Platform is controlled, operated and administered in the city of São Paulo/SP, and can be accessed by any device connected to the Internet, regardless of its geographic location.

15.1.1. Vigilantes do Sono does not guarantee that the Platform is appropriate or available for use in other locations. People who access and use Vigilantes do Sono from other jurisdictions do so on their own initiative and are responsible for compliance with regional/national laws.

15.2. The User agrees that the applicable legislation for purposes of these Terms and Conditions of Use and Privacy Policies will be that in force in the Federative Republic of Brazil.

15.3. Vigilantes do Sono and the User agree that the Forum of São Paulo/SP, Brazil, will be the sole competent to settle any issue or controversy arising from or resulting from the use of the Platform, expressly waiving any other, however privileged it may be, or may become.
